Terms of Service

The terms that govern your use of Jobyard, construction estimating and project management software for contractors.

1. Agreement to these terms

These Terms of Service (the “Terms”) are a legal agreement between you and [Jobyard legal entity name] (“Jobyard,” “we,” “us”) governing your access to and use of the Jobyard websites, applications, and services (the “Service”).

By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you are authorized to bind that company, and “you” refers to that company.

2. Your account

You are responsible for the activity that happens under your account and for keeping your login credentials secure. Notify us promptly if you believe your account has been accessed without authorization.

You are responsible for the accounts of your team members that you invite, and for the permissions you grant them within your organization.

3. Acceptable use

You agree not to misuse the Service: no unlawful activity, no attempts to breach security or access data that is not yours, no interfering with or disrupting the Service, and no uploading of malicious code.

You are responsible for the content and data you put into the Service, including estimates, client information, and files, and for having the rights to use it.

4. Your data

As between you and us, you own the data you submit to the Service. You grant us the limited rights needed to host, process, and display that data to operate the Service for you.

Each organization's data is kept private to that organization. We describe how we handle personal information in our Privacy Policy.

5. Beta service

The Service is currently offered as a private beta. It is provided as-is and may change, break, or be unavailable at times. Features may be added or removed, and we may contact you about your use of the beta.

We will give you reasonable notice before introducing paid plans or materially changing how the Service works.

6. Fees

Jobyard is free during the private beta. If and when paid plans begin, the applicable fees, billing terms, and payment processing (via our payment processor) will be presented to you before you are charged, and continued use after that point constitutes acceptance of those terms.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Jobyard is a tool to help you run your business; it does not provide legal, tax, accounting, or professional estimating advice, and you are responsible for your own bids, contracts, and figures.

8. Limitation of liability

To the fullest extent permitted by law, Jobyard will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of the Service. [Confirm any liability cap with counsel.]

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

10. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing law
